JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 The petitioner seeks regular bail in connection with Barhara P.S. Case No. 164 of 2018, registered for offences punishable under Sections 143, 152, 186, 341, 323, 353, 427 of the Indian Penal Code and Section 3 of Prevention of Damage of Public Property Act, 1984.

Allegation as per F.I.R. is that more than 100 peoples assembled to close the market and when the Circle Officer and the Police Officer tried to pacify the matter, they damaged the Government Vehicle.

It has been submitted on behalf of the petitioner that he is not named in the F.I.R., his name has surfaced in this case later on only on the basis of suspicion, however, no specific allegation has been attributed to him and he has been in judicial custody for about two months.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -II, Purnea, in connection with Barhara P.S. Case No. 164 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
