Petitioner seeks bail in K. Hat (Sahayak) P.S. Case No.549 of 2016 giving rise to S.T. No.365 of 2018 instituted for the offence under Section(s) 323, 341, 313, 376, 504, 506/34 Indian Penal Code.

Counsel for the petitioner submits that petitioner is father-in-law of the informant.

As per First Information Report, the informant was married with Md. Saif Ali on 30.11.2015. The petitioner has committed rape with her on 04.04.2015.

Counsel for the petitioner submits that as per First Information Report occurrence took place on 04.04.2015. The case has been lodged on 26.11.2016 after great delay. Petitioner

Patna High Court CR. MISC. No.30463 of 2019(4) dt.01-08-2019 2/2 is an old man. He has been falsely implicated in the case. Petitioner is in custody since 22.11.2017.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Purena, in connection with K. Hat (Sahayak) P.S. Case No.549 of 2016 giving rise to S.T. No.365 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
