2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 331(4) and 305(a) of BNS.

3. The case of the prosecution is that unknown miscreants have committed theft in the house of the informant. From his house, 10 grams of gold, 50 grams of silver and cash of Rs. 2000/- were stolen.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. During course of investigation, one co-accused Khurshid Alam was apprehended and he has given his confessional statement and in his confessional statement, he has

He has further submitted that from perusal of the seizure list, it transpires that from the possession of this petitioner, certain jewellery were recovered. Learned counsel has submitted that no TIP of the alleged articles was conducted during entire investigation and the jewellery which have been recovered from the possession of this petitioner belongs to the petitioner. In this case, charge sheet has been filed. Moreover, the petitioner is languishing in judicial custody since 26.02.2026.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and has submitted that petitioner is having criminal antecedent of five cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kalyanpur P.S. Case No. 89 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-12, East Champaran, Motihari.
