2. The petitioner apprehends his arrest in connection with Khaira P.S. Case No. 85 of 2026 for the offence registered under sections 126(2), 115(2), 117(2), 109(1), 303(2), 74, 351(2), 352, 3(5) of BNS.

3. As per the prosecution story, the informant alleged that while he was moving with his wife, 8 to 10 persons in an inebriated state intercepted it and snatched the gold chain of his wife. Upon resistance, he was assaulted with revolver butt which caused injury on his head. The informant was forced to call DIAL 112 and they reached on the spot and identified number of accused persons, the petitioner included.

4. Learned counsel for the petitioner submits that he do not have criminal antecedent and the injury has been found to be simple in nature. Further, the investigation may have taken place but still it cannot be said that he has been identified.

5. Learned APP on the other hand has taken this Court to paragraph 131 of the case diary to show that even the Dy.S.P. who supervised the matter has recorded the accusation of this petitioner and with a direction to take steps for their arrest.

6. Considering the submissions of the parties aforesaid as also the way an innocent family is being harassed/gold chain snatched, assault took place, it would be appropriate that the petitioner seek bail.
