====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 06-10-2023 Under wrong advice the instant appeal has been filed. The suit and appeal value is less than Rs. 10 lacs. The appeal lies before the District Judge concerned.

2. In the aforesaid circumstances, learned counsel for the appellant seeks permission to withdraw this appeal and file it before appropriate forum. Permission is granted. The appeal is dismissed as withdrawn.

3. The Office is directed to return the memo of appeal along with certified copy of the impugned judgment to the concerned counsel for the appellant.

4. Learned counsel for the appellant is permitted to file it before appropriate forum within 30 days.

5. The period consumed before this Court during the pendency of this appeal should be excluded at the time of considering the limitation.
