The petitioner is languishing in custody since 10.08.2014 in a case registered for the offences punishable under Section 366(A) of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

It is alleged that Vishwajeet Kumar and this petitioner enticed away the victim. The victim in 164 Cr. P.C. statement has stated that Vidhwajeet Kumar conveyed that this petitioner is calling her and consequently Vishwajeet Kumar left them at the Railway Station from where the victim went in the company of this petitioner and consequently when the petitioner came to know that his phone is being tapped he left the victim at Dehri Bus Stand. The

Patna High Court Cr.Misc. No.40885 of 2014 (3) dt.22-01-2015 2 / 2 victim has stated that she was not being sexually exploited and declined to get her medically examined.

It is submitted by learned senior counsel for the petitioner that the victim is aged about 17 years and from her own statement it appears that she of her own went in the company of the petitioner. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.
