The petitioner has filed the instant application for grant of regular bail in connection with Dumariyaghat P.S. Case No.221 of 2019 registered under sections 304B and 34 of the Indian Penal Code.
As per allegation in the FIR, the sister of the informant, soon after her marriage was tortured by the accused persons including the petitioner herein for non-fulfillment of the demand of dowry of Rs.2 lacs. It is stated that on 12.11.2019 the informant received information about the murder of his sister. They informed the police.
It is submitted by learned counsel for the petitioner that the allegation as levelled in the FIR are false and concocted.

It is submitted that the mother-in-law of the deceased, namely, Devlati Devi @ Daulti Devi @ Salhu Devi has been enlarged on bail vide order dated 11.09.2020 passed in Cr. Misc. No.22378/2020. The petitioner has no criminal antecedent and is in custody since 20.06.2020. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties, and taking into consideration the relationship of the petitioner with the deceased, the period in custody and grant of bail to coaccused, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail in connection with Dumariyaghat P.S. Case No.221 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Chief Judicial Magistrate, Motihari, East Champaran.
