The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 41, 42 and 2 of the Indian Forest Act.

As per the prosecution case, the accused persons carrying the stone after excavation the same from the forest land and due to which the forest department suffered a total loss of Rs.1,04,700/-.

It is submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case. Petitioner has clean antecedent. It is also submitted that similarly situated coaccused Ramgit Yadav has already been granted anticipatory

Patna High Court CR. MISC. No.33297 of 2019(2) dt.31-07-2019 2/2 bail by a coordinate Bench of this Court in Cr.Misc.No.58611 of 2018 vide order dated 20.09.2018.

Considering the facts and circumstances, nature of accusation as well as clean antecedent of the petitioner, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Jamui/successor Court in connection with Case No.397C2 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
