The petitioner seeks anticipatory bail in connection with Saran Town P.S.Case No. 465 of 2018, registered for offences punishable under Sections 420, 467, 468, 471, 120B and 34 of the Indian Penal Code and Section 34 of the Arms Act.

As per F.I.R., allegation against the petitioner is that the complainant purchased the land from one Shaila Devi on the basis of registered sale deed dated 23.03.1973 but it is claimed by the learned counsel for the complainant that the aforesaid sale deed dated 23.03.1973 has been declared forged and fabricated but the petitioner has no knowledge about this. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in the present

Patna High Court Cr.Misc. No.1411 of 2019(3) dt.04-02-2019 2/3 case and there is absolutely nothing against the petitioner. It is also submitted that the petitioner is accused in one case in which he is on bail.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Saran Town P.S.Case No. 465 of 2018, to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court and the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court, otherwise his bail bond shall be cancelled.
