The petitioner apprehends his arrest in Parasbigha P.S. Case No.28 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that from perusal of the seizure list, it is evident that the recovery of liquor was made from the field of Awadh Yadav, not from possession of the petitioner. The name of petitioner surfaced in the case on the disclosure made by the villagers but the names of such villages have not been mentioned in the F.I.R. Having considered the fact that nothing has been recovered from possession of the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date

No.33994 of 2019(2) dt.23-05-2019 2/2 of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II, Jehanabad in connection with Parasbigha P.S. Case No.28 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
