JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Warsaliganj P.S. Case No. 306 of 2020, registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act. As per the prosecution case, one country made pistol and a live cartridge, motorcycle and mobile phone have been recovered from possession of this petitioner. It is submitted on behalf of the petitioner that no incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedent and he is in custody since 11.09.2020. Investigation is complete. Similarly situated co-accused has already been allowed bail by this Court vide order dated 22.7.2021, passed in Cr.Misc.No. 9662/2021. Learned counsel appearing for the State opposes the

Considering the rival submissions of the parties, materials available on the record and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate Nawada in Warsaliganj Police Station Case No. 306 of 2020.
