The petitioner apprehends his arrest in connection with Bairiya P.S. Case No.167 of 2021, registered for the offences punishable under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code.

On 09.05.2022, learned counsel for the petitioner submitted before this Court that the petitioners have already been arrested by the police and prayed to withdraw the anticipatory bail application being Cr. Misc. No.65749 of 2021. Learned counsel for the petitioner submits that he made the prayer for withdrawal of the anticipatory bail application of both the petitioners inadvertently on 09.05.2022, but the fact is that the present petitioner was not arrested by the

Patna High Court CR. MISC. No.33807 of 2022(2) dt.06-07-2022 2/2 police.

In view of the facts aforesaid, I am not inclined to entertain this anticipatory bail application. Accordingly, the prayer for anticipatory bail of the petitioner is again rejected. However, if petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the learned court below shall consider the prayer for regular bail of the petitioner preferably on the same day without being prejudiced by this order considering the fact that there is no specific overt act against the petitioner.
