BAJANTHRI ORAL JUDGMENT Date : 28-01-2022 This matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 Pandemic. Mr. Sunil Kumar Mandal, SC 3 accepts notice for the Respondents.

In the instant petition, petitioner has prayed for the following relief(s):- "(i) For issuance of necessary direction upon the respondent authorities to grant promotion to the petitioner from the post of Child Development Project Officer to the post of District Programme Officer (Rs. 15600-39100/- grade pay Rs.

6600/-) w.e.f. 27-6-2018, i.e., the date on which the persons junior to the petitioner in the seniority list have been granted promotion to the post of District Programee Officer.

(ii) For issuance of necessary direction upon the respondent authorities

Patna High Court CWJC No.2759 of 2021 dt.28-01-2022 2/2 to pay all the consequential benefits including arrears of salary pursuant to grant of such promotion w.e.f. 27-06-2018.

(iii) For any other direction, which Your Lordships may deem fit and proper in the facts and circumstances of the case."

In support of the aforesaid relief(s) petitioner submitted representation on 08.06.2020 (Annexure-6) and it is pending consideration before the concerned respondent. It is learnt that on 27.06.2018 juniors to the petitioner were promoted to the post of District Programme Officer in the pay-scale of Rs. 15600-39100/- grade pay Rs. 6600/- w.e.f. 27.06.2018.

Therefore, the concerned respondent is hereby directed to decide the petitioner's representation dated 08.06.2020 (Annexure-6). If the petitioner is eligible as on 27.06.2018 petitioner shall be promoted on par with his juniors. If the petitioner is not entitled to promotion as on 27.06.2018 for any reason speaking order shall be passed and communicated to the petitioner. If the petitioner is otherwise eligible all monetary benefits and seniority shall be extended to the petitioner. With the aforesaid observations, the present writ petition stands disposed off.
