JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 The petitioner seeks regular bail in connection with N.H. Bangra P.S. Case No. 11 of 2019, registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Sectaion 30(a), 41(i) of Bihar Excise and Prohibition Act, 2016.

Allegation is of recovery of 45 litres of liquor from the house of co-accused, who disclosed the name of petitioner. It has been submitted on behalf of the petitioner that nothing has been recovered either from the possession or from the house of the petitioner and he has no criminal antecedent and has falsely been implicated in this case and he has been in judicial custody since 24.03.2019.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Samastipur, in connection with N.H. Bangra P.S. Case No. 11 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
