2. The petitioner is apprehending his arrest in connection with Shivsagar P.S. Case No. 01/2025 registered for the offences punishable under Sections 191(2)/190/126(2)/115(2)/109/74/352/351(2) of the B.N.S.S.
3. As per prosecution case, petitioner and others are said to have assaulted the informant and his family members by means of lathi, danda and iron rod as a result of which they sustained injuries.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the FIR. The petitioner bears no criminal antecedent. There is no specific allegation against the petitioner, allegations are
Patna High Court CR. MISC. No.31694 of 2025(2) dt.16-05-2025 2/3 general and omnibus in nature. There is case and counter case between the parties and free fighting cannot be ignored. He further submits that from perusal of the impugned order, it is crystal clear that injuries sustained by the injured persons are simple in nature except injuries of Kundan Kumar and Kushum Kumari which are grievous in nature and both injuries are on non-vital part of the body. He further submits that on similar and identical allegations, co-accused Sanjay Ram @ Bakuli Ram and others have already been granted anticipatory bail by the coordinate Bench of this Court vide Cr. Misc. No.23396/2025 and on the principle of parity, the petitioner also deserves same treatment.
5. The learned A.P.P. for the State opposed the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, on similar and identical allegations, co-accused have already been granted anticipatory bail, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing
