1. Heard the parties

2. The petitioner seeks regular bail in connection with Pasraha P. S. Case No. 232 of 2025 registered for the offence punishable under Section 309(4) of B.N.S.

3. The main submissions advanced by the petitioner's counsel are that the petitioner is innocent and has been falsely implicated in the present case, the petitioner is not named in the FIR and the FIR was lodged against the unknown persons and the name of the petitioner surfaced only during investigation. It is further submitted that the only allegation against the petitioner is that one mobile phone alleged to be looted article, was recovered from his possession. Learned counsel submits that the petitioner had purchased the said mobile from one Manoj Kumar for consideration amount of Rs. 1500/- and no test Identification parade has been conducted and no

Patna High Court CR. MISC. No.31981 of 2026(2) dt.12-05-2026 2/2 incriminating article except the said mobile phone has been recovered from the conscious possession of the petitioner. It is lastly submitted that petitioner has no criminal antecedent and has been in custody since 10.02.2026.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

In the facts and circumstances of this case and considering the statements made in the petition as well as above submissions, coupled with petitioner's fair and clean antecedent, his custody period and also the fact that the petitioner has mainly taken the plea that the alleged mobile phone which was found in his possession had been purchased by him and the same was supported by the apprehended co-accused Manoj Kumar, accordingly, let the petitioner named-above be enlarged on bail in connection with Pasraha P. S. Case No. 232 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
