01-11-2021 Heard learned counsel for the parties.
The petitioner seeks bail in Rafiganj P.S. Case No. 241 of 2020, registered for the offence under Sections 376, 313, 420, 120(B) of the Indian Penal Code, Section 12 of the POCSO Act and Section 3(1)(r)(s) of SC/ST Act. As per the prosecution case, this petitioner is alleged to have trapped the daughter of the informant into sex trafficking on the pretext of training as Asha Karyakarta either at Rafiganj or Aurangabad, on account of which, the daughter of the informant became pregnant. It is further alleged that this petitioner admitted the victim in a hospital, where her (victim) abortion was done, and this petitioner also threatened her not to reveal the matter, otherwise she (victim) would be killed. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to previous enmity. It is further submitted that the informant and her family
Patna High Court CR. MISC. No.43719 of 2021(2) dt.01-11-2021 2/2 members had earlier committed the murder of mother-in-law of petitioner, for which, petitioner had lodged a case under Section 302 of the I.P.C., vide Rafiganj P.S. Case No. 69 of 2011, and after investigation, chargesheet was also submitted against the informant and her husband. Victim has not been examined by doctor and there is no medical report in support of the allegation. In this case, as per FIR itself, no offence under the SC/ST Act is made out against the petitioner. Petitioner is a lady and Asha worker. She is in custody since 21.03.2021. Chargesheet has been submitted.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge VI cum Special Exclusive Judge (POCSO), Aurangabad in connection with Rafiganj P.S. Case No. 241 of 2020.
