====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY KUMAR ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Jamhore P.S.Case No. 102 of 2018, registered for the offences punishable under Sections 414/34 of the Indian Penal Code.

The informant has alleged that in the morning at about 3 A.M. on 12.09.2018 the police party apprehended a tempo, loaded with battery. The driver and other occupants of vehicle seeing the police party fled away leaving the vehicle on the spot. Accordingly, the police registered this case for the offence under Section 414/34 of the Indian Penal Code against the owner and driver of said vehicle.

It has been submitted that the petitioner is a lady, in whose name the tempo is registered. The vehicle of the petitioner was stolen away when it was parked near Imam

Patna High Court Cr.Misc. No.74538 of 2018(2) dt.17-12-2018 2/2 Chowk. In this connection she lodged a case vide Dalmianagar P.S.Case No.814 of 2018. It is further submitted that the petitioner has clean antecedent and she has been made accused in this case only on account of being the owner of the vehicle. Considering the facts and circumstances of the case, the prayer of anticipatory bail of the petitioner is allowed. The petitioner in the event of arrest or surrender before the Court below within a period of six weeks from today, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in Jamhor P.S.Case No.

102 of 2018 and also subject to the conditions that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
