2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Barhat P.S. Case No. 163 of 2024, lodged on 18.12.2024, under Sections 126(2)/115(2)/ 117(2) /109 /352 / 351(2)/ 3(5) of the Bhartiya Nyay Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against four named accused persons including the present petitioner. Allegation is that the accused persons along with others have assaulted the informant and his family members by which injury has been caused.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the informant and the petitioner are full brother. Due to petty issue the case and counter have been lodged from both the sides.
5. Counsel for the State submits that from the FIR itself it becomes crystal clear that the real dispute is for transaction of Rs.20,000/- and 2000 bricks which was the ground of settlement between the two brothers.
6. In response thereof, Counsel for the petitioner submits that he is ready to pay money of Rs.20,000/- and price of 2000 bricks to the informant.
7. In the light of the submissions made, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Chief Judicial Magistrate, Jamui, in connection with Barhat P.S. Case No.163 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
8. It is made clear that at the time of surrender, the
Patna High Court CR. MISC. No.31437 of 2025(3) dt.23-07-2025 3/3 petitioner shall deposit D.D. of Rs.36,000/- in the name of informant and then Court on being satisfied that the said amount has been received by the informant, shall accept the bail bond of the petitioner.
