18-03-2015 Heard Sri Pramod Kumar Singh, learned counsel for the petitioner and Sri Pradip Narain Kumar, learned Addl. Public Prosecutor.
This is the 2nd attempt for grant of bail. Earlier, the prayer for bail of petitioner was rejected on the ground that he was one of the main assailant. Earlier, a report was called for from the court below regarding stage of the case, which has been received and kept at flag 'A', which suggests that now case has been fixed for appearance of one of the co-accused.
The petitioner is in custody since 07-01-2013. Ofcourse, in view of the allegation, the petitioner is not entitled to be extended the privilege of bail, however; keeping in view the fact that he is in custody since January, 2013, it is desirable to
Patna High Court Cr.Misc. No.42492 of 2014 (3) dt.18-03-2015 2/2 direct the trial court to take steps for expeditious conclusion of the trial. Even in case of non-appearance of one of the co-accused, the court may take steps for bifurcating the trial so that trial of the petitioner, who is in custody, may be concluded expeditiously. The petition stands dismissed.
