1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. The petitioner has filed this modification application for extending the date of surrender on the ground that as per the order of this Court, with the consent of the parties, the informant/O.P. No. 2 was required to furnish the bank account number to enable the petitioner to deposit a sum of Rs. 3,000/- in the bank account of O.P. No. 2 starting from 10th April, 2025, positively.
3. According to the petitioner, the account number was not provided to the petitioner, as such, the petitioner could not transfer the money in the account of the O.P. No. 2 starting from 10th April, 2025.
4. Learned counsel for the O.P. No. 2 appears and submits
Patna High Court CR. MISC. No.33852 of 2025(3) dt.08-08-2025 2/2 that bank account number along with copy of the passbook has already been submitted before the Learned Sub-Divisional Judicial Magistrate, Samastipur, in Mahila P.S. Case No. 09 of 2024 on 24.04.2025, a copy of which has been handed over in Court to the learned counsel appearing for the petitioner namely Sarfe Alam.
5. Considering the aforesaid, let the time granted by this Court to surrender before the learned Court below by order dated 24.03.2025 passed in Cr. Misc. No. 7456 of 2025 be extended by further two weeks from today subject to the condition that the petitioner will deposit Rs. 15,000/- within two weeks in the bank account of O.P. No. 2, the details of which have already been provided to the learned counsel for the petitioner and every month, the petitioner will keep on depositing Rs. 3,000/- in the bank account of O.P. No. 2 starting from 10th of September, 2025.
6. Accordingly, this application is allowed to the extent indicated above.
