2. The petitioner apprehends his arrest in connection with Malaypur P.S. Case No. 125 of 2024, registered for the offences punishable under Sections 66(A), 64(1), 74, 127(2), 331(3) of BNS, 2023.

3. As per the written complaint of informant, on 16.01.2024 at about 4:00 A.M., the petitioner entered into her house, threatened her, and committed indecent acts throughout the day. When she raised alarm in the evening, villagers caught the petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. The

As a matter of fact, the relation between the petitioner and the informant was consensual and when they were apprehended by the villagers, the informant lodged this false and frivolous case against the petitioner. According to the allegation, the petitioner remained in the house of the informant from 4:00 O' Clock morning till 6 O' Clock which is impossible unless there is consent. The medical report did not support the allegation.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Malaypur P.S. Case No. 125 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) kundan/- U T
