The petitioners seek anticipatory bail in connection with Kopa P.S. Case No. 116 of 2018, registered for offences punishable under Sections 452 and 382 of the Indian Penal Code.

As per F.I.R., allegation against the petitioners is of theft of three buffaloes of the informant and thereafter, they fled away. It is also alleged that the petitioners are accused in one more case in which they are on bail.

Submission of the learned counsel for the petitioners is that there is a proceeding under Section 144 of Cr.P.C. in between the parties and that has been decided in favour of the petitioners due to that reason the present case has been lodged

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Kopa P.S.Case No. 116 of 2018 to the satisfaction of the learned A.C.J.M.-V, Chapra (Saran), subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
