JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 04-07-2025 Both applications arise out of the same case i.e. Baheri P.S. Case No. 419 of 2023 and accordingly, the same are being heard and disposed of by this common order.

2. Heard learned counsel for the petitioners and learned APP for the State.

3. Learned counsel for the petitioners has submitted that though the bail petitions of the petitioners were earlier rejected by order dated 29-07-2024 passed in Cr. Misc. No. 37404 of 2024 and its analogous cases but the petitioners are renewing their prayer for bail on the fresh ground of period of custody and also on the ground that co-accused, Ram Kumar Yadav having graver allegation to that of present petitioners, has been granted bail by a Coordinate Bench of this court vide order dated 08-04-2025 passed in Cr. Misc. No. 62811 of 2024. In his confessional statement, the said Ram Kumar Yadav has stated that he inflicted knife blows on the person of the deceased whereas the present petitioners are said to have assaulted the deceased by fist and legs. The petitioner (in Cr. Misc. No. 33552 of 2025) is under custody since 25-12-2023 whereas the petitioner (in Cr. Misc. No. 33728 of 2025) is under custody since 26-12-2023.

4. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances as well as period of incarceration and also considering the fact that co-accused, Ram Kumar Yadav has been granted bail by a Coordinate Bench of this court, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten
