JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-12-2020 In view of the submission and undertaking of the learned counsel for the petitioner, at the time of hearing of this application through Video Conferencing, that he would remove the defect(s), as pointed out by the stamp reporter, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Rail Police Station Jhajha Case No. 218 of 2019 registered under Section 379 of the Indian Penal Code.

The accusation is that informant, Bhunesh Pratap, was traveling by Train No.13050, Amritsar-Hawrah Express

Patna High Court CR. MISC. No.33062 of 2020(2) dt.15-12-2020 2/2 boarding from Lucknow for destination of Durgapur but in the way, his bag was stolen containing mobile set, PAN Card, Adhar Card, Driving Licence and cash of Rs.75,000/-. Learned counsel for the petitioner submits that on the basis of written report of informant, Bhunesh Pratal, Rail Police Station Jhajha Case No. 218 of 2019 was instituted on 04.12.2019 against unknown but in course of investigation, mobile set of the informant was being found in using by this petitioner putting his own Sim in the said mobile set. It is further submitted that petitioner has no criminal antecedent and is in custody since 28.05.2020.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Kiul, Lakhisarai, in connection with Rail Police Station Jhajha Case No. 218 of 2019 . Out of two sureties, one surety must be the close relative of the petitioner.
