====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-01-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State.

Petitioner is in custody since 19.05.2020 and seeks bail in connection with Bihariganj P. S. Case No.45 of 2020 registered for the offences punishable under Section 392 of the I.P.C.

The name of petitioner came in confessional statement of co-accused persons and, subsequently, the confessional statement of petitioner was also recorded. It appears that except the aforesaid confessional statement as well as criminal antecedent of the petitioner, there is nothing against him. It is very surprising that the Investigating Officer did not

Moreover, the investigation against the petitioner has already been completed and only on the basis of confessional statement as well as criminal antecedent, no person can be detained in judicial custody for indefinite period.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Abhimanyu Kumar, learned Judicial Magistrate, 1st Class, Uda-Kishunganj, Madhepura in connection with Bihariganj P.
