2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 448, 341, 323, 324, 504, 506, 376/34 of the Indian Penal Code.

3. As per prosecution case, petitioner entered the house of the informant when she was alone and committed rape upon her and threatened to kill her if she discloses the incident. It is further alleged that the petitioner repeated the alleged offence in the next week.

4. It is submitted on behalf of the petitioner that this petitioner is innocent and has falsely been implicated in this case. As a matter of fact, petitioner is cousin brother of informant, who is major. There was love affair between them and they got married as per Muslim custom on 15.8.2018. Police after investigation submitted final form against the petitioner but the Court below differing with the same took cognizance of the offence. and petitioner is read to marry with her and to this effect, a joint petition has also been filed in the court below. Petitioner claims clean antecedent.

5. Learned counsel for the State opposed the prayer

Patna High Court CR. MISC. No.31738 of 2025(3) dt.13-07-2026 2/2 for pre-arrest bail.

6. Considering the aforesaid facts of the case, prayer for bail of this petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.7,000/- (seven thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai in Lakhisarai Police Station Case No. 467/2018, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 as well as the condition that informant must be one of the bailors of the petitioner.
