Petitioners seek bail in Simri P.S. Case No.67 of 2019, registered under Sections 413, 414, 467 and 468 of the Indian Penal Code.

The informant got secret information that one lean and thin person was coming on a stolen motorcycle from the side of Muzaffarpur and on such a raid was conducted. The petitioner no.1 after seeing the police started fleeing away but he was arrested on chase. The motorcycle and mobiles were recovered. The petitioner no.1 did not show any paper with

Patna High Court CR. MISC. No.33350 of 2020(2) dt.15-12-2020 2/2 regard to the motorcycle. The petitioner no.1 disclosed the name of other accused persons including the petitioner no.2. Learned counsel for the petitioners submits that once the petitioner was arrested in the present case, he was made accused in five other cases. Save and except one motorcycle, nothing has been recovered from possession of the petitioner no.1 or the petitioner no.2. Petitioner No.1 is in jail since 19.05.2019 and petitioner no.2 is in jail since 21.06.2019. Taking into consideration the facts that for recovery of one motorcycle, petitioner no.1 has remained in jail for more than 11⁄2 years and petitioner no.2 from whose possession nothing has been recovered is in jail since 21.06.

2019, petitioners, namely, Kartik Kumar Sahni and Radhe @ Arjun are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga in connection with Simri P.S.
