By filing Interlocutory Application No. 4992 of 2009 it has been informed that the sole respondent,namely, Sheo Kali Kuar @ Sheo Kalia Devi died on 08.10.2008 and the sole appellant, namely, Ramni Devi also died on 15.05.2006. On behalf of the appellant adjournment was sought to seek instruction and accordingly by order dated 30.04.2015 and 14.05.2015 adjournments were granted. Now it is submitted that the sole appellant and the sole respondent have died and nobody has turned up to be substituted in place of the sole appellant. Under the circumstances, it is held that the appeal has abated as a whole. The appeal is consigned to the record. (Jitendra Mohan Sharma, J) Abhay/- U
