Petitioner seeks regular bail in connection with Aurangabad Mufassil PS Case No. 129/2020 registered for the offence punishable under Sections 302, 201, 120(B)/34 of the IPC.
As per First Information Report, family members of the girl, named in the FIR, killed the girl and a boy who were in love and the allegation against the petitioner is that he assisted the accused persons in cremating the dead bodies. Learned senior counsel for the petitioner submits that
Patna High Court CR. MISC. No.43091 of 2021(2) dt.03-02-2022 2/2 the petitioner is not the assailant and it is the family members of the girl who killed both the girl and the boy and the petitioner has falsely been implicated in this case.
He further submits that similarly situated co-accused persons, namely, Anil Singh and Upendra Singh having similar allegation have been granted bail by a Co-ordinate Bench of this Court vide Cr. Misc No. 6492/2021 and the petitioner having no criminal antecedent is in jail since 29.05.2021. Having regards to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is not the assailant, similarly situated co-accused persons have been granted bail by a Co-ordinate Bench of this Court, he is in custody since 29.05.2021 having no criminal antecedent, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, RANJAY KUMAR be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Mufassil PS Case No. 129/2020.
