JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Andharamath P.S.Case No. 95 of 2020 for the offences punishable under Sections 272, 273,414 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act .
As per allegation in the F.I.R 88.8 liters Nepali liquor was recovered from co-accused along with petitioner. Learned counsel for the petitioner submits that petitioner is falsely implicated in this case. Petitioner was not caught on the spot. Nothing has been recovered from conscious possession of the petitioner. He has no concerned with the said liquor.
Patna High Court CR. MISC. No.42532 of 2021(2) dt.02-03-2022 2/2 Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.
Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II , Madhubani in connection with Andhramath P.S Case No. 95 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
