JUSTICE SANDEEP KUMAR ORAL ORDER 05-01-2024 This application has been filed for initiation of contempt proceeding against the opposite parties for willful violation of the judgment and order 28.11.2022 passed by this Court in C.W.J.C. No. 2433 of 2019.

Pursuant to the last order dated 08.12.2023, the Project Director of the NHAI is present before this Court. 3.

Learned counsel for the petitioners submits that the petitioner will appear in Miscellaneous Case Nos.47 and 48 of 2023 pending in the Court of the District Judge, Gopalganj

Patna High Court MJC No.1462 of 2023(4) dt.05-01-2024 2/2 under Section 34 of the Arbitration and Conciliation Act, 1966 on the next date of hearing.

Once the petitioners appear and file their reply, if any, then the case shall be heard and decided, as directed earlier.

The District Judge, Gopalganj will himself dispose of the Miscellaneous Cases, as directed by this Court vide order dated 28.11.2022 passed in C.W.J.C. No.2433 of 2019. If required, the District Judge, may recall the date and hear the parties at the earliest. The lawyer for the NHAI will also cooperate in the disposal of the Miscellaneous Cases. The aforesaid cases shall not be adjourned unnecessarily on the prayer of either of the parties.

With the aforesaid observations and directions, this application is disposed of.

Since this application is disposed of, there is no need for passing any order with regard to the personal appearance of the Project Director.
