JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 This is an application for grant of anticipatory bail in connection with Shankarpur P.S. Case No. 16 of 2013, disclosing offences under Sections 302, 34 of the Indian Penal Code.

Allegation against the petitioner and several other accused persons is of assaulting the deceased, later on he succumbed to the injury and the case is of the year 2013. Submission of learned counsel for the petitioner is that there is general allegation of assault against the petitioner and the main allegation is against co-accused Sambhu Yadav. Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner on the ground that in this case charge-sheet has already been submitted showing the petitioner absconder.

No.74755 of 2018(3) dt.11-04-2019 2/2 Having heard both sides, in view of the facts and circumstances of the case as stated above, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.

Accordingly, this application is dismissed.
