JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-01-2021 The present petition has been filed for modifying the order dated 20.11.2019 passed in Criminal Misc. No. 75017 of 2019 to the extent that the time granted to the petitioner to surrender before the learned court below be extended by a further period of four weeks from today.

The learned counsel for the petitioner has submitted that on account of the circumstances mentioned in paragraph nos. 4 to 6 of the present petition, the petitioner could not surrender before the learned court below within the stipulated time period, resulting in expiry of the time period granted to him to surrender.

No.8387 of 2021(2) dt.30-01-2021 2/2 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the averments made in the present petition, I deem it fit and proper to extend the time period granted to the petitioner to surrender before the learned court of A.D.J.-II-cum-Special Judge (Excise Act), Katihar in connection with Nagar P.S. Case No. 638 of 2019, by a further period of four weeks from today.

Accordingly, the order dated 20.11.2019 passed in Criminal Misc. No. 75017 of 2019 stands modified. The petition stands allowed.
