The petitioners seek bail in anticipation of their arrest in connection with Sahajitpur P.S. Case No. 18/2020 dated 3.3.2020 instituted for the offences under Sections
Patna High Court CR. MISC. No.32406 of 2020(2) dt.09-02-2021 2/3 302, 120(B), 201 and 34 of the Indian Penal Code. The petitioner nos. 1 and 3 are the brothers in law of the deceased whereas, petitioner no. 2 is the father in law of the deceased. According to the First Information Report, which has been lodged by the father of the deceased, the deceased had earlier complained that the petitioners and the wife of the deceased have been threatening him of dire consequences. The deceased had come from Bombay but had gone to his in-laws house. Later, his dead body was recovered in a half burnt condition in an orchard. The informant has suspicion that the petitioners and the wife of the deceased have got him killed.
Learned counsel for the petitioners has submitted that there is no eye witness to the occurrence and the accusation against the petitioners is only on suspicion. There is no material to connect the petitioners with the offence. However, this court is not inclined to grant anticipatory bail to the petitioners.
The prayer for anticipatory bail is rejected. In case the petitioners surrender before the Court
Patna High Court CR. MISC. No.32406 of 2020(2) dt.09-02-2021 3/3 below and seek bail, their applications shall be considered on its own merits without being prejudiced by the fact that the present petition for grant of anticipatory bail has not been entertained.
