The petitioner seeks bail in anticipation of his arrest in connection with Raghopur (Rustampur O.P.) P.S. Case No. 92 of 2020 dated 14.06.2020 instituted for the offences under Sections 414/34 of the Indian Penal Code and Sections 30(a)(c)(d)/41 of the Bihar Prohibition and Excise Amendment Act, 2018.

Though the recovery of liquor is from an open space but considering the fact that the petitioner was earlier made accused in a case of similar nature, I am not inclined to grant anticipatory bail to him.

However, if the petitioner surrenders before the Court below and seeks bail, that petition shall be considered on its own merits without being prejudiced by the fact that the present petition for grant of anticipatory bail has not been entertained.
