2. The petitioner is apprehending his arrest in Bakhtiyarpur P.S. Case No. 284 of 2023 registered under Sections-420, 406, 409, 469, 468, 201, 120(B) of the Indian Penal Code.
3. The complainant/informant is the Secretary of N.J.S. College, Athmalgola. He lodges complaint, which is basis of the present FIR. According to the complainant/informant, the coaccused, Sitaram Pandit was former in-charge Principal of that college and the petitioner was accountant of that college. He committed financial irregularities from 16-05-2014 to 12-012016. Due to embezzlement done by the accused persons, the

The petitioner, who was accountant of that college, despite reminders, did not hand over the charges. Ultimately, the almirah of account section was opened in presence of the teachers and videography of the same was also prepared. From that almirah, an incomplete cashbook was recovered, in which, entries only for one and a half months i.e. from 01-04-2015 to 20-05-2015 were found and out of 190 pages, six pages were found filled up. A number of papers which shows implication of the petitioner, were also recovered from that almirah.
4. It has been submitted on behalf of the petitioner that the occurrence is of the year, 2015 and the FIR has been lodged in the year, 2023. He has also submitted that the petitioner was selected as Assistant Professor in 2017 and he resigned from his post in the year, 2017.
5. On the otherhand, Sri J. N. Thakur, learned A.P.P. has submitted that when the new regime came and the complainant/informant became Secretary, the irregularities done by the accused persons were detected. At the relevant time, the petitioner was the accountant of the college. He did not hand over the charge despite reminders and an incomplete cash book was recovered from the almirah. 6. Considering the aforesaid facts and circumstances, the petitioner is not entitled for privilege of anticipatory bail and accordingly, the same is rejected.
