1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Sherghati (Dobhi) P.S. Case no. 960 of 2023 registered under sections 420, 467, 468 and 414 of the Indian Penal Code.
3. As per the prosecution case, the informant states that in course of checking one Ganesh Kumar was caught and on being asked by police personnel was unable to produce any documents with respect to motorcycle. He disclosed to the police that he had purchased the said motorcycle for Rs. 15,000/- from this petitioner.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. Neither the petitioner was arrested at the spot and nor any incriminating article recovered from his possession. The accused who was allegedly caught at place of occurrence with the stolen
Patna High Court CR. MISC. No.35638 of 2024(2) dt.10-05-2024 2/2 motorcycle, namely Ganesh Kumar has been enlarged on bail vide order dated 24.1.2024 passed in Cr. Misc. no. 1361 of 2024. The petitioner has no concern with the alleged motorcycle. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the F.I.R, no incriminating article having been recovered from petitioner's possession and the petitioner not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Sherghati (Dobhi) P.S. Case no. 960 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
