The petitioner seeks bail in anticipation of his arrest in connection with Jagdishpur P. S. Case No. 25 of 2020, dated 12.02.2020, instituted for the offences under Sections 363, 366, 342, 376 and 34 of the Indian Penal Code.

Regard being had to the nature of accusation in the F.I.R., I am not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail is rejected.

No.32974 of 2020(3) dt.13-04-2021 2/2 However, if the petitioner surrenders before the court below and seeks bail, the court below shall look into the entire set of facts, including that the petitioner is distantly related to the victim and there are reasons for suspecting false implication of the petitioner, and shall pass orders in accordance with law, without being prejudiced by the fact that the present petition has not been entertained by this Court.
