The petitioner apprehends his arrest in connection with Tekari (Mou O.P.) P.S. Case No. 40 of 2019, registered for the offences punishable under Sections 341, 323, 354 (A), 379, 386, 506 read with 34 of the Indian Penal Code. Marriage of the daughter of the informant was fixed with the co-accused Kunal Kumar but subsequently it was broken and was fixed with some other person. On the date of occurrence while informant along with his wife and daughter were proceeding market by bus taking cash Rs. 1,56,000/- for marketing the articles used in the marriage, said Kunal Kumar along with his three associates including the petitioner boarded on it and started teasing his daughter and assaulted them and
Patna High Court CR. MISC. No.30364 of 2019(2) dt.07-05-2019 2/3 snatched away aforesaid money from the informant. Out of them two accused were apprehended by the police and other two accused including the petitioner managed to escape taking aforesaid money.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner have been falsely implicated in this case. Allegation levelled against the petitioners is not specific rather general and omnibus in nature. As a matter of fact, marriage of Kunal Kumar was fixed with the daughter of informant and after break up Kunal Kumar had returned all the articles accorded to him in the marriage but the informant has not returned the articles accorded to him from the side of Kunal Kumar and filed this case to grab the same. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, VI, Gaya in connection with Tekari (Mou O.P.)
