JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 27-10-2021 Heard learned senior counsel for the petitioner assisted by Mr. Arya Achint, learned counsel and Mr.Jai Prakash Singh, learned counsel for the informant as also Mr. Md. Fahimuddin, learned APP for the State.

This is the second attempt of the petitioner to obtain bail in connection with Fulwariya P.S. Case No.124/2019 registered for the offences punishable under Sections 341, 307, 302 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier the prayer for bail of the petitioner was rejected vide order dated 10.11.2020 passed in Cr.Misc.No.29175 of 2020 after finding that the petitioner is the

In course of argument, learned senior counsel for the petitioner could not point out any change of circumstance or any material so as to change the opinion of this Court. Considering that the petitioner happens to be the main assailant, this Court is not inclined to release him on bail. It is stated that the petitioner is in jail for two years. While learned senior counsel for the petitioner submits that there is no progress in the trial, learned counsel for the informant has informed this Court that the charges have already been framed.

Let the trial be expedited. All endeavours be made to conclude the trial as early as possible.
