The petitioner seeks regular bail in Bakhtiarpur Police Station Case No. 260 of 2019 registered for the offences punishable under sections 307/302 and other allied sections of the Indian Penal Code.
As per the prosecution case, petitioner along with coaccused Ranjit and other 6/7 unknown persons reached the tea shop of the informant. Thereafter, petitioner and his accomplice Ranjit entered the tea shop and started indiscriminate firing as a result of which informant sustained firearm injury in his thigh and when he tried to escape, these accused persons again fired on him causing injury in his left waist.

No.31766 of 2020(3) dt.10-08-2021 2/2 Learned counsel for the petitioner submits that there is series of litigation between the parties with respect to right and title over disputed land of the tea shop for which Title suit No.184 of 2017 is still pending between them and the informant in order to put pressure has falsely implicated the petitioner and his family in the instant case. Petitioner is in custody since 17.2.2020. Charge sheet has already been submitted. Learned counsel for the State and the informant oppose the prayer for bail and submit that there is specific allegation against the petitioner that he along with his accomplice made indiscriminate firing causing firearm injury in the thigh of the informant and one of the injured died during course of treatment. Petitioner has also got criminal antecedent. Considering the rival submissions of the parties, materials available on the record and the gravity of the offence, prayer for bail of the petitioner is refused. (Prabhat Kumar Singh, J) Shashi U T
