The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other F.I.R. named accused abused and assaulted the informant and his mother, as a result of which, mother of informant sustained knife injury in her hand. It is further alleged that accused also snatched Rs. 3500/- from the pocket of informant. It is submitted on behalf of petitioner that the allegation is general and omnibus in nature and no specific overt act has been alleged against this petitioner. As a matter of fact, petitioner and informant reside in the same locality and due to some petty dispute, this false case has been lodged. Injury sustained by the mother of informant has been found to be simple in nature. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.33739 of 2022(2) dt.15-11-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Patna in connection with Kankarbagh P.S. Case No. 29 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
