In this case, the petitioner is seeking anticipatory bail in connection with Bhagwanpur P.S. Case No.106 of 2011, registered for the offence punishable under Sections 406 and 420 of the Indian Penal Code.

Allegation has been made that the petitioner, who is a PDS dealer, failed to distribute the foodgrains to the beneficiaries under the SGYP Scheme.

Counsel for the petitioner submits that even after lapse of 7-8 years, the investigating agency could not complete the investigation.

Case No.106 of 2011 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
