2. The petitioner is apprehending his arrest in Deepnagar P.S. Case No. 200 of 2024 registered under Sections 366(a)/34 of the IPC.

3. As per written report of informant Sanjay Kumar Singh, on 07.06.2024, his daughter went missing near Pawapuri Railway crossing while travelling with her grandmother. He alleges that the petitioner enticed and took her away with the involvement of his parents, Gauri Devi and Naveen Singh. Despite hectic search, she could not be found. Accordingly, the present case was registered.

4. Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.34694 of 2025(5) dt.04-12-2025 2/2 the victim did not support the prosecution case in her statement recorded under Section 164 of the CrPC. She stated that she had gone with the petitioner to Mumbai of her own sweet will.

5. On the other hand, learned counsel for the informant has opposed the prayer for bail and submitted that the date of birth of the victim is 11.06.2009, according to her school leaving certificate, which is annexed in the case diary. The victim is a minor girl.

6. Considering the aforesaid facts and circumstances, the petitioner does not deserve the privilege of anticipatory bail and accordingly, the same is rejected.

7. The petitioner is directed to surrender before the court below and seek regular bail. If the petitioner does so, the same shall be disposed of on its own merit, without being prejudiced by this order.
