JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-07-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For a direction to the Respondents to remove the encroachment from State Highway No. 20 at Dhamauli Bazar- Supasang Road which is a public road situated at Thana No. 28, Khata No. 68, Plot No. 798, area 1.30 acres in the district of Nalanda.

(ii). For a direction to the Respondents to take appropriate action against the persons who have encroached upon the public road for which the Anchal Ameen has submitted a report before Respondent No. 6 through Memo No. 156 dated 28.01.2014."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the Respondent 6 i.e. the Circle Officer, Rahui, District-Nalanda, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case appropriate petition is filed by the petitioner, under the provisions of the Bihar Public Land Encroachment Act, 1956, before the Respondent No. 6, within a period of four weeks from today, he shall take appropriate steps, in accordance with law, forthwith. 4.

Accordingly, the present writ petition stands disposed off on the aforesaid terms.
