====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Gwalpara (Arar O.P.) P.S. Case No. 69 of 2018 registered under Sections 302, 201 and 120(B)/34 of the Indian Penal Code.

On recovery of two dead bodies, Gwalpara (Arar O.P.) P.S. Case No. 69 of 2018 was instituted against unknown. Learned counsel for the petitioner submits that in course of investigation, Geeta Devi, identified the dead body of his son, Raju, on the basis of cloths and other dead body of Rajesh, friend of her son, Raju and she also stated that one Nitu

Patna High Court CR. MISC. No.76284 of 2018(4) dt.30-04-2019 2/2 Kumari used to talk with her son, Raju, on telephone. Thereafter, Suraj Kumar, brother of Nitu Kumari, was apprehended by the police, who confessed his guilt about committing the murder of Raju and Rajesh due to love affairs with his sister, Nitu Kumari. Later on, police raised suspicion about having hand of the petitioner being brother-in-law of Suraj Kumar, except that nothing has been collected against the petitioner showing the involvement in the alleged crime and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Madhepura, in connection with Gwalpara (Arar O.P.) P.S. Case No. 69 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
