The petitioner apprehends his arrest in Laukahi P.S. Case No. 289 of 2021, registered for the offences punishable under Sections 20/22 of the Narcotic Drugs and Psychotropic Substances Act.

As per the prosecution case, 800 gms of Ganja has been recovered from the dickey of motorcycle of this petitioner which was parked in a thatched house.

It is submitted that neither the motorcycle nor the house in which raid was conducted belong to this petitioner. Petitioner claims clean antecedent.

Counsel for State however vehemently opposed the prayer for bail and submitted that from bare perusal of FIR and Seizure list it is apparent that petitioner is the owner of vehicle

Patna High Court CR. MISC. No.34506 of 2022(2) dt.15-11-2022 2/2 and the house in question.

Considering the facts aforesaid and recovery of narcotic drugs from motorcycle of this petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
