JUSTICE ALOK KUMAR SINHA ORAL ORDER 10-07-2025 Heard learned counsel for the petitioner, learned counsel appearing for the Municipal Corporation, Sitamarhi and learned counsel appearing for the respondent-State.

2. With the consent of both the parties, this writ application is being disposed of at this stage itself.

3. Learned counsel for the petitioner submits that for the reliefs claimed for in the present writ application, the petitioner has already filed a representation dated 10.03.2025

Patna High Court CWJC No.8222 of 2025(2) dt.10-07-2025 2/3 before the Municipal Commissioner, Municipal Corporation, Sitamarhi vide Annexure-P/3, which is still pending. Learned counsel for the petitioner further submits that he would be satisfied if an appropriate direction is issued by this Court to the Municipal Commissioner, Municipal Corporation, Sitamarhi to dispose of the representation of the petitioner on merit after giving an opportunity of hearing to the petitioner, within a fixed time frame by passing a reasoned and speaking order.

4. The aforesaid prayer being made by learned counsel for the petitioner is not opposed by the learned counsel appearing for the Municipal Corporation, Sitamarhi.

5. Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of directing the Municipal Commissioner, Municipal Corporation, Sitamarhi to dispose of the representation filed by the petitioner dated 10.03.2025 vide Annexure-P/3 on merit after giving an opportunity of hearing to the petitioner, by passing a reasoned and speaking order. The entire exercise must be completed by the Municipal Commissioner, Municipal Corporation, Sitamarhi within three months from the date of production of a copy of this order by the petitioner.
