JUSTICE RAJAN GUPTA) 01-08-2022 In the present writ petition a direction has been sought to the respondent authorities to renew the contract which has been rescinded. According to the parties, there was an Agreement No. 10 SBD of 2019-20 dated 09.12.2019. Learned counsel for the respondents however confiscated the security deposit paid by the petitioner and further propose to blacklist the petitioner.

At the outset, learned counsel appearing for the

Patna High Court CWJC No.13417 of 2021(6) dt.01-08-2022 2/2 respondents submits that in case, the petitioner files a fresh representation within two weeks from today, it shall be considered by the competent authority i.e., the Engineer in Chief, Road Construction Department, Patna and a speaking order shall be passed.

Learned counsel for the petitioner is satisfied with the statement. Thus, no further adjudication is necessary. The petition stands disposed off.

In case, the parties are not able to resolve their dispute, they may also explore the possibility of invoking the arbitration clause which admittedly is contained in the agreement.
